Neutral Citation No. - 2025:AHC:25741-DB Court No. - 42 Case :- CIVIL MISC REVIEW APPLICATION No. - 30 of 2025 Applicant :- Smt. Indra Gupta Opposite Party :- State Of U.P. And 2 Others Counsel for Applicant :- Piyush Patel,Shailesh Verma Counsel for Opposite Party :- Ambrish Shukla,C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard learned learned counsel for the applicant and Shri Ambrish Shukla, learned counsel for the UPSIDA - respondent Nos.2 and 3. 2. Shri Ambrish Shukla, learned counsel for UPSIDA, has raised an objection regarding the maintainability of the instant review application. He states that the judgment dated 08.07.2024 was challenged in Petition for Special Leave to Appeal (C) No. 23942 of 2024 (Indra Gupta vs. The State of U.P. and Others), and the Hon'ble Apex Court, vide order dated 21.10.2024, dismissed the same on merits. In this backdrop, learned counsel for UPSIDA submits that once the judgment and order dated 08.07.2024 have already been affirmed by the Apex Court on merits, the instant review application is totally misconceived. He further argues that even the document relied upon (on Page 37 of the paper book) is not applicable, as it pertains to one Purshottam Kumar and not the petitioner. He contends that, in the present case, the terms and conditions had been violated, which has already been upheld by the Apex Court, and therefore, no interference is warranted. 3. In view of the aforesaid, since the impugned judgment and order have been affirmed by the Apex Court, we are not inclined to entertain the instant review application, and the same stands rejected.
