17 2025:HHC:16745 Bhawarna, in which, the applicant Uttam Singh is stated to have been acquitted; ii) FIR No. 13 of 2018, dated 24.2.2018, under Sections 406 IPC, registered with P.S. H.P. 7.26 It has been pleaded in the status report that reports from RFSL, Dharamshala and SFSL, Junga are awaited.
Charge sheet, in the present case, has been prepared and submitted to the Court of learned ACJM, Palampur, District Kangra, H.P. 7.27 On the basis of above facts, it has been apprehended that the applicants are very clever persons and in case, they are ordered to be released on bail, they may coerce the witnesses and may also hamper the investigation of the case. 7.28 Lastly, it has been apprehended that the applicants have committed a heinous crime and in case, they are ordered to be released on bail, in
18 2025:HHC:16745 that eventuality, chances of demonstration by the common people, are there. 7.29 On the basis of aforesaid facts, a prayer has been made to dismiss the application. 8. So far as the role, which has been attributed to applicant Sushil Kumar (applicant), is concerned, as per the stand of the Police, when, accused Nishu Bala informed him about the incident as to how accused Ajay Kumar inflicted two blows of the iron rod on the head of deceased Pankaj Kumar and he fell down, her husband did not believe her version and directed her to attend the marriage. 9. As per further case of the Police that after attending the marriage at about 10:30 p.m, her husband applicant Sushil Kumar, Ajay Kumar, her sister Rajni Bala had gone to the store room alongwith blanket and wrapped the dead body of deceased Pankaj Kumar and tied the same with
19 2025:HHC:16745 rope and put the same in dickey of vehicle No. HP56A-2976 and later on, applicant Sushil Kumar disclosed to his wife that they had thrown the dead body in the forest towards Jwala Ji. 10. During police custody on 20.2.2025, accused Nishu Bala and applicant Sushil Kumar made a disclosure statements, under Section 23 of BSA and on the basis of said statement, accused Nishu Bala identified the place at Batahan. Thereafter, team of RFSL also visited the spot and collected the physical evidence from there. Thereafter, accused Nishu Bala produced the iron rod, with which, fatal blows were inflicted upon deceased Pankaj Kumar.
Applicant Sushil Kumar had produced the vehicle No. HP56A-2976, which was used for disposing off the body, by throwing the same in the forest. 11. Applicant Sushil Kumar, in pursuance of his disclosure statement, identified the place,
20 2025:HHC:16745 where dead body was allegedly thrown. He has also disclosed that he alongwith Rajni Bala, Nishu Bala, Ajay Kumar, Abhishek Kumar had destroyed the evidence by burning the jacket, pair of slippers, blanket, tarpaulin and rope. Ashes from the spot were also taken into possession. Applicant Sushil Kumar also identified the place at Kalidhar, where dead body was thrown. 12. Considering the role attributed to applicant Sushil Kumar, as referred to above, this Court is of the view that releasing applicant Sushil Kumar on bail, at this stage, would give wrong signal to the society that after committing such a heinous crime, that too, in a planned manner, he is moving freely in the society. 13 Even otherwise, behaviour of applicant Sushil Kumar after getting information regarding the murder of deceased Pankaj Kumar, from his wife, is not normal and instead of taking swift
21 2025:HHC:16745 action, in this regard, he pursuaded his wife to attend the marriage and later on, with the help of Ajay Kumar and Rajni Bala, he put the dead body of Pankaj Kumar in the car and disposed off the body by throwing the same in the forest. Not only this, they had allegedly burnt the wearing apparels of deceased Pankaj Kumar, alongwith other articles, in order to destroy the evidence. 14. In view of above, applicant Sushil Kumar is not able to make out a case for bail and as such, he is not entitled to be released on bail. Consequently, his bail application bearing No. 1027 of 2025, is dismissed. 15.
So far as the role, which has been attributed to applicant Uttam Singh, in the present case, is concerned, as per the prosecution case, on 22.2.2025, accused Nishu Bala made a disclosure statement under Section 23 of the BSA and disclosed that after death of deceased Pankaj
22 2025:HHC:16745 Kumar, she has taken out the mobile phone and keys of motorcycle of deceased Pankaj Kumar from his pocket and kept the same with her, in order to destroy the evidence. Thereafter, she handed over the same to her father applicant Uttam Singh to conceal/destroy the same at a place known as ‘Menjha’ at Palampur. 16. Police has alleged that applicant Uttam Singh also played an active role in the commission of crime and he, in active connivance with other accused persons, disposed off the body of deceased Pankaj Kumar and also destroyed the evidence. As such, it has been apprehended that he may coerce the witnesses. However, no disclosure statement has been stated to have been made by applicant Uttam Singh. 17. The age of applicant Uttam Singh has been mentioned in the status report as 70 years. He is permanent resident of District Kangra, H.P. As
23 2025:HHC:16745 such, for the apprehensions, which have been expressed by the Police, in the status report, qua applicant Uttam Singh, reasonable conditions can be imposed, in case, he is ordered to be released on bail. 18. Chances of conclusion of trial against applicant Uttam Singh, in near future, are not so bright, as such, no useful purpose would be served by keeping applicant Uttam Singh in judicial custody, for indefinite period. 19. The role allegedly attributed to applicant Uttam Singh will be proved during trial. As such, his bail application cannot be rejected merely as a matter of punishment, since the pre-trial punishment is prohibited under the law.
20 So far as the registration of case FIR No. 13 of 2018, dated 24.2.2018, registered under Section 406 IPC, with Police Station, Panchrukhi, District Kangra, H.P. which is pending adjudication before
24 2025:HHC:16745 the learned ACJM, Palampur, District Kangra, H.P., is concerned, mere registration of an other case does not take away the presumption of innocence of applicant and he is presumed to be innocent, till he is proved guilty, after the full-fledged trial. 21 Considering all these facts, this Court is of the view that the bail application bearing No. 1028 of 2025 is liable to be allowed and is accordingly allowed. 22. Consequently, applicant Uttam Singh is ordered to be released on bail in case FIR No. 12 of 2025, dated 15.2.2025, registered under Sections 103(1), 140(1), 3(5), 61(2) and 238 of the BNS, with Police Station, Panchrukhi, District Kangra, H.P., on his furnishing personal bond in the sum of Rs. 50,000/-, with one surety in the like amount, to the satisfaction of learned trial Court. 23. This order, however, shall be subject to the following conditions:-
25 2025:HHC:16745 a) Applicant shall regularly attend the trial Court on each and every date of hearing and if prevented by any reason to do so, seek exemption from appearance by filing the appropriate application; b) Applicant shall not tamper with the prosecution evidence nor hamper the investigation of the case in any manner whatsoever; c) Applicant shall not make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or the Police Officer, and d) Applicant shall not leave the territory of India without the prior permission of the Court. 24. Any of the observations, made herein above, shall not be taken, as an expression of opinion, on the merits of the case, as these observations are confined, only to the disposal of the present bail applications. 25.
It is made clear that the respondent-State is at liberty to move an appropriate application, in case, any of the bail conditions, is found to be violated by the applicants. 26. The Registry is directed to forward a soft copy of the bail order to the Superintendent of
26 2025:HHC:16745 Open Air Correctional Home, Dharamshala, District Kangra, H.P. through e-mail, with a direction to enter the date of grant of bail in the e-prison software. 19. In case, the applicant is not released within a period of seven days from the date of grant of bail, the Superintendent of Open Air Correctional Home, Dharamshala, District Kangra, H.P. is directed to inform this fact to the Secretary, DLSA, Kangra. The Superintendent of the Open Air Correctional Home, Dharamshala, District Kangra, H.P. is further
