Applicant- Dev Patel, who is in judicial custody in connection with Case Crime No.394 of 2024, under Sections 103 (2), 109, 115(2),190, 191(2), 191 (3), 351 (3) and 352 of Bhartiya Nyaya Sanhita (BNS), 2023, registered at Police Station Kotwali Gang Nahar, District Haridwar, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant contends that the applicant is not named in the FIR; on medical examination, the deceased was conscious and the injuries were K.U.O.; the injured was said to have died on 29.09.2024 after about one month of the alleged incident and in the autopsy of the dead body of the deceased conducted on 30.09.2024, the cause of death was opined by the Doctor Septicemia due to abdominal trauma consequent upon physical assault with sharp edged weapon. 6. It is further contended that the complainant of the case is neither a witness of the alleged incident nor he disclosed the name of any accused, of the applicant; the applicant has falsely been implicated and there is no material on record to connect the applicant with the alleged incident. 7. Per contra, learned Deputy Advocate General vehemently opposed the bail. 8. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that application deserves bail at this stage. 9. Accordingly the bail application is allowed. 10. Let the applicant, namely, Dev Patel be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
