JUSTICE S.G.PANDIT) Heard learned counsel Smt.Rakshitha D.J. for the appellants; Smt.Saritha Kulkarni, learned AGA for respondent No.1; Sri.K.Prasanna Shetty, learned ounsel for respondent No.3 and learned counsel Sri.K.Srinivas for Smt.Sangeetha for respondent No.2(A-C). Perused the entire writ appeal papers. 2. Sri.Srinivas, learned counsel appearing for respondent No.2(A to C) would submit that subsequent to filing of the above appeal, the second respondent/employee died and his legal representatives are brought on record. Further, it is submitted that, subsequent to his death, all terminal benefits of respondent No.2 employee has been settled. It is also submitted that since the delinquent employee had died, taking further action in the matter would not arise. - 4 - HC-KAR NC: 2025:KHC:21539-DB WA No. 54 of 2022 3. Learned counsel for the appellant would not dispute the above fact. 4. Taking note of the submission of the learned counsel appearing for the parties, we are also of the considered opinion that in view of death of respondent No.2/employee, taking further action would not arise, in terms of learned single judge’s order under challenge. Hence, no purpose would be served in considering the appeal on merits. Question of law, if any, raised is kept open. 5. With the above, the writ appeal stands disposed of.
