Neutral Citation No. - 2025:AHC-LKO:25662 Court No. - 18 Case :- WRIT - A No. - 4819 of 2025 Petitioner :- Ms. Preeti Mishra Respondent :- State Of U.P. Thru. Prin. Secy. /Addl. Chief Secy. Deptt. Of Child Development And 6 Others Counsel for Petitioner :- Mayankar Singh,Raghvendra Mani Ojha Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner as well as the learned Standing Counsel appearing for respondent nos. 1 to 6. Notice to respondent no. 7 is dispensed with in view of the proposed order. Under challenge is the impugned order, contained in Annexure No. 1 to the writ petition, whereby her complaint—alleging that despite being a widow, preference was given to a candidate possessing an EWS certificate—has been rejected. Perused the record. A perusal of the government order dated 21.03.2025 shows that the post of Anganwari Karyakatri is to be filled in accordance with reservations prescribed from time to time for various categories, including EWS, Scheduled Castes, Scheduled Tribes, and Other Backward Classes, as per the relevant government directives. It is an admitted position that the petitioner did not apply under the EWS category, although the seat in question was earmarked for that category. Consequently, in terms of the above Government Order, preference must be given to an eligible candidate belonging to the EWS category. In view of the fact that the seat was reserved for the EWS category and the petitioner did not apply under that category, her candidature cannot be considered. There appears to be no illegality in the order impugned. The writ petition lacks merit and is accordingly dismissed. Order Date :- 2.5.2025 R.C.
