JUSTICE SANJAY KUMAR MEDHI ORDER 30.05.2025 Heard Shri PK Mazumdar, learned counsel for the petitioner, who has approached this Court for a direction for release of contractual dues. Notice was issued on 25.08.2021 and Shri C. Sarma, learned counsel appearing on instructions of Shri RM Das, learned Standing Counsel, Water Resource Department. The writ petition was filed for release of an amount of Rs.1,10,241/-, Shri Sarma, learned counsel has however submitted that certain amounts have already been paid and as per the instructions, balance amount of Rs.59,618/-. He accordingly prays for 3(three) months time to clear the balance. From the pleading exchanged and as submitted by the learned counsel for the respondents – Department, it appears that there is no dispute to the claim and only paucity of funds have been cited to be the reasons. However, considering that the balance amount is of Rs.59,618/-, this Court directs the respondents – Department to clear the balance amount within a period of 45 days from today.
