Neutral Citation No. - 2025:AHC-LKO:22553 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 2293 of 2025 Petitioner :- Tribhuwan Dutta Tripathi Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home, Sultanpur And Others Counsel for Petitioner :- Rajiv Kumar Bajpai,Suparna Mishra Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard Ms. Suparna Mishra learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel. The petitioner has approached this Court with a very limited prayer that the proceedings under Section 25(1) of the Societies Registration Act 1860 is engaging the attention of the respondent no.2/Presiding Officer where the election is under challenge. It is urged that repeated dates are being fixed, however, no fruitful progress has been made in the proceedings and in the aforesaid circumstances it is urged that some expedite order be passed so that the matter can be taken to its logical conclusion. Considering the prayer which has been made this Court, at this stage, it does not deem appropriate to either issue notice to the private respondent nos.3 to 5 or call for any response as the matter is already before the respondent no.2 and no gainful purpose would be served in keeping the writ petition pending. Accordingly, the petition is disposed of with a direction to the respondent no.2 to consider and decide the pending case under Section 25(1) of the U.P. Societies Registration Act, 1860 bearing Case no.7338 of 2024; Computerized Case No.T202404680307338 as expeditiously after affording opportunity of hearing to the parties but without granting any unnecessary adjournment to either of the parties. It is made clear that the Court has not examined the case of either of the parties on merits and respondent no.2/Presiding Officer shall decide the case strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 22.4.2025/Harshita Digitally signed by :- HARSHITA High Court of Judicature at Allahabad, Lucknow Bench
