Mr. Saurabh Kumar Pandey, Advocate, holding brief of Mr. Mani Kumar, Advocate for the respondent. 3. Respondent has filed a suit for divorce against applicant no. 1 before learned Family Court, Udham Singh Nagar, which is numbered as Family Case No. 304 of 2023. Applicants have sought transfer of the said suit to a court of competent jurisdiction at Haridwar. 4. As per the averments made in the Transfer Application, marriage between the parties was solemnised on 25.01.2008, and thereafter, two child were born out of the said wedlock, on 21.09.2008 and 01.04.2012, however subsequently, relations between the parties became strained and respondent ultimately filed a suit for divorce under Section 13(1) (ia) (ib) of Hindu Marriage Act. 5. Notice was sent to respondent and Mr. Mani Kumar has put in appearance on behalf of the respondent. Today, Mr. Saurabh Kumar, Advocate, holding brief of Mr. Mani Kumar, on instructions, makes a statement that respondent has no objection to the prayer for transfer made by the applicants and the case can be transferred to Family Court, Haridwar. 2025:UHC:5218 6. In view of the concession made on behalf of the respondent, Transfer Application is allowed. Proceedings of Family Case No. 304 of 2023, pending before Family Court, Rudrapur, Udham Singh Nagar is transferred to a court of competent jurisdiction at Haridwar. This Court hopes and expects that the transferee Court shall make endeavour to decide the case as early as possible. The record of the case shall be transferred to the transferee Court, within three weeks. 7. Registry shall communicate this order to both the Courts, electronically by 24.06.2025.
