Secy. Women Welfare Deptt. Lko. And Another Counsel for Applicant :- Hari Anuj Bahadur Sinha Hon'ble Rajeev Singh,J. 1. Heard. 2. The instant contempt application has been filed by the applicant alleging disobedience of the order dated 18.07.2024 passed by this Court in Writ-A No. 5399 of 2024. 3. Learned counsel for the applicant submits that as the grievance of the applicant was not being ventilated, a writ petition i.e. Writ-A No. 5399 of 2024 was filed, which was disposed of on 18.07.2024 with the observation that the petitioner is permitted to move fresh representation within ten days before the competent authority enclosing his earlier representations along with all relevant documents. It was also observed therein that if such a representation is moved, the competent authority concerned is directed to dispose of the representation of the petitioner with speaking and reasoned order, strictly in accordance with law expeditiously, say within a period of two months from the date of production of the certified of the order. It is further submitted that in the representation of the applicant, prayer was made for payment of dues as the representation has already been decided by the competent authority on 12.09.2024 with the observation that budget is not available, hence, retiral benefits cannot be paid to the applicant. It is next submitted that direction passed by the writ Court has not been complied with in letter and spirit by the respondents, hence, they may be summoned and punished accordingly. 4. It is evident from the order passed by the writ Court that direction was issued for taking decision on the representation of the applicant, but there is no direction to the State Government regarding budget allocation. 5. At this stage, learned counsel for the applicant prays for withdrawal of the instant contempt application with liberty to file writ petition before appropriate Court. 6. Accordingly, the contempt application is dismissed as withdrawn with liberty to take appropriate remedy as available to the applicant.
