In compliance of the earlier orders passed by this Court, the Chief Judicial Magistrate Lakhimpur Kheri has sent a report dated 10.09.2024. 2. We have gone through the said report sent by the C.J.M. Lakhimpur Kheri wherein it has been stated that the sole respondent- Ram Prakash @ Bablu S/o Radhey Shyam Awasthi, had died on 05.06.2016. The statements of the Village Pradhan and the Sub Inspector of the Police Station concerned, have been enclosed to the said report. 3. Since the sole respondent- Ram Prakash @ Bablu, has died during the pendency of the Appeal, the instant Appeal is liable to be dismissed as abated. 4.
