The applicant is in judicial custody in Sessions Trial No. 140 of 2024, State Vs. Karamjeet Sandhu and others, arising out of FIR No.322 of 2024, dated 28.06.2024, under Sections 307, 504, 120-B and 34 IPC and 3/25 of the Arms Act, 1959, Police Station Rudrapur, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 27.06.2024, two motorcycle borne assailants came near to injured Prashant and the pillion rider of the motorcycle opened two fire on injured Prashant, due to which, he sustained injuries.

Learned counsel for the applicant would submit that there is no evidence against the applicant except the statement of the co-accused and confession of the applicant. He would submit that the alleged recovery is not supported by the Forensic Science Laboratory Report.

Learned State counsel has not disputed the factual aspects.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
