HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CPSW No. 438/2015 In SWP No. 2445/2013 Aras Hussain Shah & Ors. …..Petitioner(s) Through: None. Vs Shalin Kabra & Anr. .….Respondent(s) Through: Mr. Raman Sharma, AAG with Ms. Saliqa Sheikh, Advocate. CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER (20.12.2025) 01. Three petitioners in this contempt petition had come forward with a writ petition SWP No. 2445/2013 praying thereby consideration of their writ claim in terms of a judgment passed in the writ petition SWP No. 961/2003 which was upheld by the Division Bench in LPA(SW) No. 49/2008 in terms of judgment dated 30.07.2009. 02. The writ petition so preferred by three petitioners came to be disposed of in terms of an order dated 14.11.2013, with a direction to the writ respondents to consider the case of the petitioners in light of the observations made in judgment dated Serial No. 05 Supplementary List-1 2 CPSW No. 438/2015 In SWP No. 2445/2013 31.12.2007 in SWP No. 961/2003 read with LPA judgment dated 30.07.2009 in LPA(SW) No. 49/2008. 03. The very fact that the requisite consideration must have been accorded to the case of the petitioners during the pendency of this contempt petition, otherwise the petitioners would have come forward with an intervention application complaining that there cause has not been accorded consideration, as such, this Court is well within its judgment to assume that the compliance of the directions given in the order dated 14.11.2013 has been carried out rendering the contempt petition infructuous, as such, dismissed.
