And 2 Others Counsel for Petitioner :- Ram Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Rajesh Singh Chauhan,J.
1. Heard Shri Ram Kumar Singh, learned counsel for the petitioners and Dr. Uday Veer Singh, learned Additional Chief Standing Counsel for the opposite party Nos. 1, 2 & 3. 2. By means of this writ petition, the petitioners have prayed for the following reliefs:-
"(i) to issue a writ, order or direction in the nature of certiorari to quash the impugned order dated 08.04.2025 passed by the opposite party No.3, contained as Annexure No.1 to the writ petition. (ii) to issue a writ, order or direction in the nature of mandamus commanding the opposite party No.3 to approve the resolution dated 27.12.2024 passed by the petitioner No.2."
3. Learned counsel for the petitioners has stated that the opposite party No.3 has not taken any decision on the Resolution dated 27.12.2024 passed by the petitioner No.2 and the impugned order dated 08.04.2025 has been passed in an unwarranted manner. 4. Dr. Uday Veer Singh, learned Additional Chief Standing Counsel has drawn attention of this Court towards Annexure No.8 of the writ petition, which is an order dated 25.07.2024 passed by this Court in Writ-A No.5442 of 2024; Mayank Bajpai vs. State of U.P. & others in the case of the present petitioner protecting the interest of the petitioner. 5. On that, larned counsel for the petitioners has stated that the aforesaid interim order has not been complied with and after expiry of the period of six months, the interim order dated 25.07.2024 has lost its efficacy. He has also submitted that the aforesaid writ petition has also rendered infructuous., however, the same is pending before this Court. 6. Having considered the submissions of learned counsel for the
parties, since the opposite party No.3 is to take appropriate decision on the Resolution of the petitioner No.2 dated 27.12.2024, therefore, such authority is directed to take appropriate decision on the Resolution dated 27.12.2024 of the petitioner No.2 i.e. Sahkari Sangh Limited Tikaitnagar, Block- Puredalai, District-Barabanki through its President/ Sabhapati Preeti Singh. 7.
Since an interim order dated 25.07.2024 has lost its efficacy inasmuch as the petitioners have not filed any contempt petition before expiry of six months period, therefore, the appropriate decision may be taken by the opposite party No.3 independently. The aforesaid decision may be taken with expedition preferably within a period of one month from the date of presentation of a certified copy of this order and the decision thereof shall be intimated to the petitioners forthwith. 8. It is also made clear that I have not entered into merits of the issue. 9. Accordingly, the instant writ petition is disposed of finally.
