Sri Ratnesh Chandra, learned counsel for the Lucknow Development Authority has filed an affidavit on behalf of Sri Sanjive Kumar, Executive Engineer, Zone-7, Lucknow Development Authority, Lucknow today in the Court, which is taken on record. The Officer, who was summoned, namely, Sri Sanjive Kumar, Executive Engineer, Zone-7, Lucknow Development Authority, Lucknow, is present. He has expressed apology for the recitals contained in the show cause notice dated 27.03.2025. We were not inclined to accept the apology at all, but, for the fervent pleas of Sri Ratnesh Chandra, his counsel. We warn the officer to be very careful in future and not to pass any order which may be in the teeth of the order of the High Court, otherwise, the consequences would be very serious. The officer has assured us that he will not do it again and also that he will withdraw the show cause notice, therefore, we do not proceed against him. The show cause notice shall be withdrawn by the officer, who is present, within 24 hours. A fresh notice may be issued to the petitioner but not by the officer, who has appeared before us, it shall be issued by some other officer, for which, the Vice Chancellor, Lucknow Development Authority may pass requisite orders in pursuance to our earlier order dated 22.10.2024 passed in Writ C No.7745 of 2024.
