The present Petition under Article 226 of the Constitution of India has been filed by the Petitioner–Nisha with the following prayers: “(i) To issue a writ, order, or direction in the nature of certiorari quashing the impugned FIR dated 09.11.2024, registered as Case Crime/FIR No. 0328 of 2024, under Section 8/22 of the N.D.P.S. Act at Police Station Ramnagar, District Nainital, against the Petitioner. (ii) To issue a writ, order, or direction in the nature of mandamus directing the Respondents not to arrest the Petitioner in pursuance of the FIR dated 09.11.2024, registered as Case Crime/FIR No. 0328 of 2024, under Section 8/22 of the N.D.P.S. Act at Police Station Ramnagar, District Nainital, against the Petitioner.” 4. The present matter arises out of Case Crime/FIR No. 0328 of 2024, under Section 8/22 of the N.D.P.S. Act, within the jurisdiction of Police Station Ramnagar, District Nainital. The co-accused- Javed Khan, was apprehended with prohibited drugs and, during investigation, allegedly stated before the police that he, along with his wife (the present Petitioner–Nisha), was involved in the transaction of scheduled drugs, namely Buprenorphine Injection IP Bupine and Pheniramine Maleate Injection IP Avil. 5. Learned State Counsel, however, submits on the basis of the report sought that the Petitioner is neither named nor found involved in the present matter. Accordingly, on the basis of the said report, the Petition has become infructuous. Learned State Counsel further submits that, as per telephonic instructions, the Call Detail Records (CDR) in the present matter are still awaited, and the Investigating Team is examining the possible connection between the Petitioner and the co-accused Javed Khan. 2025:UHC:7922 6. In view of the above submissions and the report placed on record, the present Writ Petition is dismissed as infructuous.
