Neutral Citation No. - 2025:AHC-LKO:22466 Court No. - 8 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1146 of 2025 Applicant :- Krishna Pratap Singh Opposite Party :- Swarnmala Singh, Civil Judge (S.D.) Ii / Addl. Cjm-Ii, Ayodhya Counsel for Applicant :- Amit Kumar Singh,Prashansa Singh Hon'ble Jaspreet Singh,J. Heard learned counsel for the applicant. The instant contempt petition has been filed alleging that non compliance of the order dated 16.10.2023 whereby in a petition under Section 483 bearing no.661/2023 a direction was issued to the trial court to conclude the trial with expedition preferably within a period of six months from the date of the order is produced before the Court. It is the case of the petitioner that despite the said order having been placed before the Court concerned yet the trial court has not concluded the trial and as such there is a deliberate and willful disobedience of the order passed by the Court dated
16.10.2023. The Court has considered the aforesaid submissions and perused the material on record specially Annexure no.3 which is extract of the order sheet which is not certified copy but a typed copy. After taking note of the aforesaid, it indicates that on certain dates complainant himself was not present which led to the fixing of dates. On certain occasions accused was not appearing and considering the same, the Court has issued non bailable warrants. Despite the same, there does not appear to be any material to indicate that there is any willful disobedience committed by the Presiding Officer. It may be that the complaint has not been decided within time as expressed by the Court but nevertheless it cannot be construed that there is any deliberate or willful disobedience, hence, this Court is not inclined to issue notice on the contempt to the Presiding Officer.
However, taking note of the earlier direction given by the Court, this Court deems necessary to observe that the trial court shall ensure that the proceedings are taken to its logical conclusion expeditiously. With the aforesaid, the application is disposed of. Order Date :- 21.4.2025 Harshita Digitally signed by :- HARSHITA High Court of Judicature at Allahabad, Lucknow Bench
