Neutral Citation No. - 2025:AHC-LKO:22523 Court No. - 13 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 433 of 2025 Applicant :- Yusuf @ Yousuf Ahmad Khan Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Khaleeq Ahmad Khan Counsel for Opposite Party :- G.A. Hon'ble Manish Mathur,J.
1. Supplementary affidavit filed today is taken on record.
2. Heard learned counsel for the applicant and learned Additional Government Advocate appearing on behalf of opposite party no.1.
3. First Anticipatory Bail Application has been filed with regard to Case Crime no.725 of 2023, under Sections 419, 420, 406 I.P.C., P.S. Hargaon, District Sitapur.
4. As per contents of first information report, the complainant is said to have been deceived by applicant who cheated him of amount due to him by fraudulently withdrawing a substantial sum of money from informant's bank account deceitfully.
5. Learned counsel for applicant submits that applicant has been falsely implicated in the charges levelled against him which would be evident from fact that informant himself admits having affixed his thumb imprint on withdrawal form whereafter only the said amount was withdrawn.
6. Learned Additional Government Advocate has opposed anticipatory bail with submission that statement of informant clearly corroborates allegations levelled in F.I.R. He has also adverted to fact that charge sheet has
been filed but non-bailable warrant has been issued against applicant.
7. Considering the submissions advanced by learned counsel for the parties and upon perusal of material on record, this Court feels that it would be appropriate for applicant to apply for regular bail before court concerned.
8. In view of aforesaid, the present application is disposed of granting liberty to applicant to apply for regular bail before court concerned which may be considered and decided in terms of decision of Hon'ble the Supreme Court in Satender Kumar Antil versus Central Bureau of Investigation and another reported in (2022) 10 SCC
