R/O- VILL.- KATHALGURI, P.S.- UDALGURI, DIST.- UDALGURI, ASSAM. VERSUS THE STATE OF ASSAM REPRESENTED BY THE LD. PP, ASSAM Advocate for the Petitioner : A W AMAN, A MISHRA,SAMIM RAHMAN,MR. SURAJIT DAS,MR SARFRAZ NAWAZ Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 31.07.2025 Heard Mr. S. Nawaz, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor appearing for the State of Assam. The gist of accusation in this case is that on 30.01.2025, two informant, namely Sunil Kumar Gupta and Vikash Kumar Gupta had lodged an F.I.R before the Officer-in-Charge of Page No.# 2/2 Dispur Police Station, inter-alia, alleging that on 22.11.2024, the informants have paid advance money of Rs. 19,20,000/- to the co-accused and the petitioner for purchase of four vehicles. Pursuant to an order dated 04.06.2025, the petitioner has appeared before the I/O and his statement has been duly recorded. Considering the nature of the allegation, I am of the view that custodial interrogation of the petitioner is not called for and since the statement of the petitioner has already been recorded, I consider it a fit case to grant pre-arrest bail to the petitioner. Accordingly, the order dated 04.06.2025 is hereby made absolute with the same terms and conditions. Anticipatory bail application stands disposed of. JUDGE Comparing Assistant
