Therefore, the present contempt petition is not maintainable at this point of juncture. 2) Learned counsel for the petitioner after arguing for sometime seeks permission of this court to withdraw the present contempt petition with liberty to file fresh petition before an appropriate forum. 2 3) In view of the submission made by the respective parties, this court is of the considered opinion that the respondent has already retired from his services before passing of the said order. Therefore the instant contempt petition is not maintainable at this stage.
