Counsel for Petitioner :- D.R.Misra Counsel for Respondent :- C.S.C. Hon'ble Brij Raj Singh,J. List revised. Case called out. None has appeared for the petitioner. However, learned standing counsel is present for the State. By this writ petition, the petitioner has prayed for the following main reliefs :-
"(i). issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 15.11.2000 passed by the opposite party no. 2 contained as Annexure 1 to this writ petition ; (ii). issue a writ, order or direction in the nature of mandamus commanding the opposite parties to allow the pensionary benefits to the petitioner w.e.f. 01.01.1981." By this writ petition the petitioner had prayed for the pensionary benefits. It has been stated in para 8 of the counter affidavit filed on behalf of respondents no. 1 and 2 that husband of the petitioner died on 12.05.1959 whereas the provision for family pension was introduced by the Government/Department only on 01.10.1981. Thus, the prayer of the petitioner cannot be granted. In view of the above, the writ petition is misconceived and has become infructuous. Accordingly, the writ petition being infructuous is consigned to record. Interim order, if any, stands discharged.
