Heard Mr. Prashant Singh, learned counsel for the petitioners. Also heard Mr. Shashank Thakur, learned Deputy Advocate General for respondent / State. 2. The present petition has been filed seeking following relief(s):- “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent to cease all coercive recovery proceedings against petitioners till the pendency of the writ petition and consider the petitioners' situation as victims of fraud, in the interest of justice. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 3. Subject matter of the case in brief is that this case revolves around a large-scale financial fraud orchestrated by Flora Max Company, which deceived 170 economically weaker individuals by promising financial assistance to establish small businesses. The victims, mostly from rural and underprivileged backgrounds, were lured by the company's assurances that it would facilitate loans from various banks and also assist in their repayment. Relying on these false promises, the victims obtained loans from 14 various Banks, with the expectation that Flora Max Company would support them in repaying the borrowed amounts. However, after collecting a substantial sum of money through this fraudulent scheme, the company's director, Akhilesh Singh, along with other officials, suddenly shut down operations and absconded, leaving the victims in financial distress. Following the company's disappearance, the victims were left solely responsible for repaying the loans, which they were unable to do due to their already precarious financial conditions. As a result, they began facing constant harassment from bank officials and aggressive recovery agents, who subjected them to undue pressure, threats, and intimidation to recover the loan amounts. The petitioners took legal action and lodged an FIR on 17/12/2024 at Mahasamund Police Station against the directors and officials of Flora Max Company. Despite this, no significant action was taken by law enforcement authorities, leaving the victims vulnerable to ongoing financial and mental distress. In pursuit of justice, they further escalated their complaint by submitting a representation to the Superintendent of Police, Mahasamund, on 08/02/2025, urging authorities to take swift and decisive action against the fraudsters. Now, the petitioners seek justice, and relief from their loan liabilities, as they were misled into borrowing funds under false pretences. Hence, this petition. 4. Learned counsel for the petitioner submits that the company made false promises of small businesses, deceiving the petitioners into 15 taking loans under the pretence of establishing small businesses. The company absconded after receiving substantial sums from the petitioners, leaving them in severe financial distress. The company's actions amount to criminal breach of trust as funds were collected under false assurances. The deliberate misrepresentation and subsequent disappearance of company representatives constitute cheating under IPC. Further, despite filing an FIR against the company on 17/12/2024, no effective action has been taken to trace and prosecute the accused. The inaction of authorities has further aggravated the financial crisis of the petitioners. Petitioners, lacking financial literacy, were misled into taking loans without fully understanding the terms. They should be treated as victims of fraud rather than willful defaulters and are facing relentless harassment from officials of Arohan Bank, L&T Bank, Gram Shakti Bank, ISAF Bank, and others. These banks, instead of acknowledging the fraud and the victims' plight, are engaging in unethical recovery practices, including threatening calls, public shaming, coercion and amount to mental harassment of individuals who have already suffered due to company fraud. 5. Learned State Counsel submits that it is not in dispute that the petitioners herein have taken loan from the various private banks and invested the same in the Flora Max Company, which absconded with the funds, hence the petitioners are liable to pay the debts taken from the private banks. Further, as the petitioners 16 have taken debts from the private companies including Arohan Bank, L&T Bank, Gram Shakti Bank, ISAF Bank and others, as such, they are under obligation to repay the loan borrowed by them. As such, the relief prayed for by the petitioners is undefinable and vague and the present petition deserves to be dismissed on this ground alone. 6. We have heard learned counsel for the parties and perused the documents appended with the petition. 7. From perusal of the records, the allegation is that the petitioners herein took loan from the various private banks and invested the same in the Company named as styled as Flora Max Company, and the said company later absconded with the funds, thus the petitioners are liable to pay the debts taken from the private banks. Considering the submissions advanced by learned counsel for the parties and the fact that the prayer made by the petitioners is obscure and vague, in view of the same, we are not inclined to interfere in the matter, as such, the present petition is dismissed, leaving it open to the petitioner to take recourse to law before the appropriate forum.
