PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/Sec.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking anticipatory bail, in Crime No.189/2024 of Narsipatnam Town Police Station, Anakapalle District. 2. A case has been registered against the petitioner and others for the offence punishable u/Sec.109, 118(1) r/w 3/5 B.N.S. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. 2 4. Case of the prosecution, in brief, is that, one Majji Nageswararao (defacto complainant) has been living with his family by running samosa business. The elder brother of the defacto complainant has been in live relationship with one Nargana Parvathi of SC colony for the past few years. On 01.9.2024 at about 4.00 pm, the grandchildren of said Majji Ramana and their friends were taking photos and videos at Shanmukhnagar layout and later shared them with their brothers. On seeing the said videos A1, A3 to A8 who are residents of Kothaveedhi went to that location with an intention to kill them due to previous disputes in between them and caused injuries to them. Later at about 9.15 pm, said Majji Ramana along with his grandsons went to BC Colony to confront with A2 about the earlier attack and in that process A1 hit said Ramana on his face and caused injuries. One Durga Prasad who was passing by the side was also attacked by A1 with knife, whereas his left ear caused further injuries. Accused attacked the grandchildren and the said Durga Prasad beat with sticks and that all the injured were shifted to area hospital, Narsipatnam and from there they were shifted to K.G. Hospital, Visakhapatnam for better treatment. Basing on the report of the defacto complainant, Narsipatnam town police registered the same. 5. Heard. Perused the record. 6. Learned counsel for the petitioner submits that the petitioner and the defacto complainant are relatives and they had previous disputes 3 between them and due to the said reason, this false case was foisted against the petitioner and the ingredients of section 109(1) of B.N.S have no application to the facts of the case and prays to allow the criminal petition. 7. Learned Assistant Public Prosecutor submits that the investigation is at crucial stage in this case and prays to dismiss the criminal petition. 8. A perusal of the record and the contents of the report shows that all the accused persons proceeded together and out of which some serious accusation have been made against Shaik Jeelani and Crime under section 3(5) of B.N.S. was also registered against the petitioner. Though at this stage it cannot be said that the petitioner has not participated in the commission of the offence with an intention to kill. But learned Public Prosecutor has vehemently opposed the anticipatory bail application on the ground that 12 antecedents were reported against the petitioner and rowdy sheet was also pending. In view of the same, this Court is not inclined to grant anticipatory bail to the petitioner. 9.
