Hon'ble Karunesh Singh Pawar,J.
1. Heard learned counsel for the petitioner as well as learned Standing Counsel for respondents no. 1 to 4 and perused the record. 2. Notice to respondent no.5 is dispensed with in view of the proposed order. 3. By this petition, the petitioner has prayed the following reliefs:-
"(i) issue a writ, order or direction in the nature of certiorari thereby quashing the impugned order dated 11.3.29025 issued by the opposite party no. 3, the District Programme Officer, Raebareli, after summoning the same from the custodian. (ii) issue a writ, order or direction in the natgrue of mandamus commanding the opposite party no. 2 to 4 to appoint the petitio9enr on the post of Aanganwadi Karyakatri for the Gram Panchayat Daudpur, Block- Harchandpur, District Raebareli as she has obtained highest quality point marks i.e. 17.07 while Nidhi Patel and Babita Verma are having quality point marks 13.384 and 11.993 respectively. (iii) issue a writ, order or direction in any nature which this Hon'ble Court may deem fit and proper under the circumstances of the case."
4. Learned counsel for the petitioner submits that the petitioner has obtained 17.07 marks whereas the private respondent has secured lesser marks than the petitioner still she has been selected. 5. Learned Standing Counsel on the basis of written instruction submits that the petitioner has only Intermediate qualification and has secured 9.12 marks whereas the respondent no.5 -Nidhi Patel has secured 13.384 marks and she is also graduate. As per the Government Order dated 21.3.2023 which lays down the guideline and procedure for appointment of Aanganwadi Karyakatri. The merit list has to be prepared on the basis of
educational qualification highest being the Post Graduate. Since the respondent no. 5 is a graduate, therefore, she has secured higher marks than the petitioner and accordingly she has been selected on the post of Aanganwadi Karyakatri. 6. Instructions provided. 7.
In view of above, considering the fact admittedly the petitioner is not a graduate and she has secured lesser marks than the private respondent who is a graduate and as per the policy dated 21.3.2023, the merit list has been prepared, in which the respondent no.5 has been selected, there appears to be no illegality in the selection of private respondent on the post of Aanganwadi Karyakatri. 7. Thus, the petition is devoid of merit and is dismissed. Order Date :- 18.4.2025 Muk Digitally signed by :- MOHD UMAR KHAN High Court of Judicature at Allahabad, Lucknow Bench
