Petitioner has filed a suit for partition in respect of Abadi bearing Gata No.46Ga which according to him belongs to the petitioner and his other family members who are private opposite parties herein but S.D.M. as is alleged is getting a Nali constructed over the said Abadi land. In the suit which has been filed, the State of U.P. through Collector is not an opposite party nor is the Zila Panchayat or any local body. 3. These are not matters to be seen under Article 226 of the Constitution of India especially as the land in question is Abadi land. Petitioner may pursue other remedies prescribed in law. 4.
