2. The appeal in question i.e. FAO 120/2020 had been filed by Mr. Chander Shekhar and Mrs. Shanti Devi and who had filed a claim seeking compensation on account of their son Mr. Pankaj (since deceased) meeting
“untoward incident” while travelling as a bonafide passenger in a train.
3. The abovesaid appeal has already been allowed by this Court vide
judgment dated 06.05.2025.
4. The present application has been moved by appellant No.2 who submits that when the appeal was filed, she was known as “Mrs. Shanti Devi” but, thereafter, she changed her name to “Suman” and in view of the abovesaid development and change in her name, which has no element of malafide, the compensation would not be released to her. 5. However, such aspect can always be looked into by the learned Railway Claims Tribunal.
6. The present application stands disposed of with request to the learned Railway Claims Tribunal to consider the prayer made by the mother of the deceased passenger and after ascertaining her bonafide and credentials, the Tribunal would be at liberty to disburse the compensation, in terms of order passed by this Court on 06.05.2025.
