Appellant / Petitioner Vs. 1.The State of Tamil Nadu, Rep. by its Secretary to Government, Agricultural Department, Fort St.George, Chennai-9. 2.The District Collector, Sivagangai, Sivagangai District. 3.The Assistant Director of Agricultural, Ulavar Maiyam, Sivagangai District. 4.The Branch Manager, State Bank of India, Silukupatti Branch, Sivagangai District. ... Respondents / Respondents 1/6 https://www.mhc.tn.gov.in/judis W.A(MD) No.1999 of 2025 PRAYER: Writ Appeal filed under Clause 15 of Letters Patent, praying this Court to set aside the order dated 09.12.2024 made in W.P. (MD)No.15099 of 2019 by allowing this appeal. For Appellant : Mr.R.Suriya Narayanan For Respondents : Mr.N.Ramesh Arumugam Government Advocate for R1 to R3 JUDGMENT (Judgment of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides. 2. The appellant claims to have cultivated 92.5 ares in Survey No. 110/8 ad 66.5 ares in Survey No.111/14 in Silukkupatti Village, Kalaiyarkoil Taluk. The appellant had also remitted the premium to insure himself against crop loss. Cause of action pertains to fasili year 2017-2018. When the appellant claimed the crop insurance amount, his request was not considered. Hence, the appellant filed W.P.(MD)No. 15099 of 2019. The learned single Judge dismissed the writ petition on 09.12.2024 in the following terms:- 2/6 https://www.mhc.tn.gov.in/judis W.A(MD) No.1999 of 2025 “3. On enquiry, the Tahsildhar, Kalaiyarkovil, found that the petitioner is not an owner of the land comprised in Survey Nos. 110 and 111 situated at Kavanikarai Village, Silukapatti Group Kalaiyarkovil Taluk, Sivagangai District. Therefore, the ownership as well as the accident of land are under question. Further, it is also differs from the Adangal Extract from claim by the petitioner. 4. In view of the above, the claim of the petitioner was not recommended, since the petitioner is not entitled for insurance. Hence, this Writ Petition is devoid of merits. Accordingly, this Writ Petition is dismissed. ” Aggrieved by the same, this writ appeal came to be filed. 3.We wanted to know from the learned Government Advocate as to why, the writ petitioner was not recommended. The learned Government Advocate submitted that during the relevant time, the revenue officials had issued the adangal for actual extent of land. It is stated that the actual extent of Survey Nos.110 and 111 respectively is 8.92.5 Ha and 14.66.5 Ha but crop insurance Adangal has been issued to the extent of 30.05.0 Ha and 23.22.5 Ha. Since adangal had been illegally issued over and above the actual extent by the concerned VAO and there was a duplication of adangal certificate and multiple enrolment, the claim amount received from the ICICI Lomboard had been kept “withheld” in 3/6 https://www.mhc.tn.gov.in/judis W.A(MD) No.1999 of 2025 their bank account. We are clearly of the view that the role of the District Collector is to disburse the crop insurance amount. If irregularities had been committed, it is the duty of the District Collector to weed out the ineligible applicants and grant relief to the eligible ones. He has to necessarily undertake a factual enquiry. 4. We are aware that the crop insurance scheme contemplates the grievance redressal mechanism. The appellant is permitted to submit a fresh application before the District Collector, Sivagangai. The District Collector, Sivagangai will go by the parameters laid down in the scheme and resolve the issue. We are not giving any positive direction that the appellant should be paid. All that we are directing is that eligible farmers ought to be disbursed with the crop insurance amount. The entire exercise shall be completed within a period of three months from the date of receipt of a copy of this order. The order of the learned single Judge is set aside. 4/6 https://www.mhc.tn.gov.in/judis W.A(MD) No.1999 of 2025 5. The writ appeal is disposed of. No costs. (G.R.S., J.)
