Present petition is been filed for issuance of a writ of certiorari quashing final selection list for Anganbadi Karyakatri in Center barahsinga, Gram Sabha Barahsinga, district Sitapur with a further writ of mandamus directing appointing authority to consider candidature of the petitioner for selection as Anganbadi Karyakatri. Learned Standing Counsel, on the basis of written instructions which are taken on record, submits that the petitioner who is Intermediate and Graduate has secured 10.151 marks in merit whereas the private respondent No.5 who is also a Graduate has secured 12.793 marks in merit and thus, on the basis of higher merit, she has been selected. It is thus submitted by learned standing counsel that the submission of the petitioner that private respondent is not a graduate is false. In view of the above and the fact that the respondent No.5 has been selected on the basis of higher merit and she is also a graduate and her selection has been made in pursuance to G.O. dated 21.3.2023 as well as advertisement, I find no illegality in the impugned selection.
