Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 4. 2. Notice to respondent No.5 is dispensed with in view of the proposed order. 3. By this petition, the petitioner has prayed for the following relief:- "(i) to issue a writ, order or direction in the nature of certiorari to quash appointment of private respondent after summoning the record from the concerned authorities who has been appointed on the post of Anganbari Karyakatri in Nagar Palika Pihani, Ward- Mirsaray, Centre- Mirsaray, Block- Pihani, Tehsil Shahabad, District Hardoi ignoring the norm of law. (ii) to issue a writ, order or direction in the nature of mandamus to commanding the respondents concerned to give appointment to the petitioner on the post of Anganbari Karyakatri in Nagar Palika- Pihani, Ward- Mirsaray, Centre Mirsaray, Block- Pihani, Tehsil- Shahabad, District Hardoi in the interest of justice." 4. After arguing for sometime, learned counsel for the petitioner submits that he may be permitted to move a fresh representation to the respondent No.2, and the same may be directed to be decided by the respondent no.2. 5. Learned Standing Counsel has no objection to this innocuous prayer. 6. Perused the record. 7. In view of the above, without entering into the merit of the case, the writ petition is disposed of granting liberty to the petitioner to file a fresh representation before respondent No.2 i.e. District Program Officer, District Hardoi within two weeks from today and in case, such a representation is submitted, the same shall be decided by respondent no. 2 within a further period of four weeks by passing a reasoned and speaking order.
