Sri Mohan Singh has stated that the controversy in hand has already been settled by this Court as a Special Appeal (Defective) No. 681 of 2010 has been decided on 28.07.2010. Considering the fact that the period of appointment for the post in question, i.e., Rojgar Sevak is only for three years, thereafter the fresh engagement is done strictly in accordance with law. On that learned counsel for the petitioner has stated that the petitioner maybe permitted to participate in fresh selection and his candidature may be considered strictly in accordance with law.
