1. Heard Mr. Mohanty, learned counsel for the petitioners and Mr. Satpathy, learned ASC for the State.
2. Instant petition is filed for release of the petitioners on bail in connection with G.R. Case No.517 of 2024 arising out of Gondia P.S. Case No.327 of 2024 pending in the file of learned J.M.F.C., Gondia, Dhenkanal on the grounds stated therein.
3. Perused the FIR and the rejection order as at Annexures-1 and 2 respectively.
4. It is informed to the Court that the investigation is in progress. As far as the allegations in the FIR are concerned, the petitioners are responsible for the alleged incident of robbery. It is claimed that no case of dacoity is made out. It is submitted by Mr. Satpathy, learned ASC that an amount of Rs.4,000 and some odd was recovered from the petitioners. Considering the circumstances leading to the recovery and seizure and the fact that the petitioners are in custody from 2nd November, 2024, the Court is inclined to direct them to go on bail subject with stringent conditions though petitioner No.1 is having one more antecedent.
5. Accordingly, it is ordered.
6. In the result, the petition stands allowed. As a necessary corollary, the petitioners are directed to be released on bail in connection with G.R. Case No.517 of 2024 arising out of Gondia P.S. Case No.327 of 2024 subject to them furnishing bail bonds of Rs.40,000/- (rupees forty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned J.M.F.C., Gondia, Dhenkanal, who shall impose such other conditions as deemed just and proper in the facts and circumstances besides the following, such as, they shall not commit similar type of offence, while on bail.
7. Urgent certified copy of this order be granted as per rules.
