This is first bail application moved by the applicant seeking regular bail in Case Crime No.336 of 2021, under Sections 376(2)(n), 376(2)(p), 376 (3) I.P.C. and Section 3(A)/ 4(ii) , 5(L)/6, 5 (n) and 6 of POCSO Act, registered at Thana/P.S. Kankhal, District Haridwar. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime; has no criminal history and is languishing in jail since long. He submits that applicant has no relations with his wife and, on the instructions of her mother, victim (daughter of the applicant) has given statement against the applicant; that the allegations levelled against the applicant are not medically proved. He submits 2025:UHC:4652 that in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel vehemently opposed the bail application. He submits that, in the statements of the victim recorded under Section 161 and Section 164 Cr.P.C., she has categorically made allegations against the applicant, who is father of the victim. He submits that specific role has been assigned to the present applicant and, as such, applicant should not be granted bail. 5. I have considered the submission advanced by the learned counsel for the parties. I am not inclined to grant bail to the applicant at this stage. The bail application is rejected.
