Heard Sri Puneet Chandra learned counsel for the petitioner and Sri Pankaj Srivastava learned Additional Chief Standing counsel for the State respondent. By means of the present petition, the petitioner prays for following reliefs:- "(i) Issue a writ, order or direction in the nature of mandamus commanding the opposite party no.2 to decide the petitioner's objections/representation dated 26.09.2024 (annexure no.1) and 28.02.2025 (annexure no.2) by a reasoned and speaking order, expeditiously and preferably within a time-bound period as may be deemed just and proper by this Hon'ble Court; (ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite party no.2 to decide the petitioner's application dated 28.02.2025 (annexure no.3) for settlement of alleged deficit stamp duty under the Government Order dated 26.12.2024 by a reasoned and speaking order, expeditiously and preferably within a time bound period as may be deemed just and proper by this Hon'ble Court. (iii) Issue a writ, order or direction in the nature of mandamus restraining the opposite parties from taking any coercive action including sealing, auctioning or dispossessing the petitioner from the portion of the property bearing no.31/82, Jahangirabad Mansion, M.G. Marg, Hazratganj, Lucknow, detailed in para 8 of writ petition till the disposal application/representations contained in Annexure 1, 2 and 3 to this writ petition." Learned counsel for the petitioner has filed second supplementary affidavit which is taken on record. This Court on 15.04.2025 had required the State to seek complete comprehensive instructions in respect of the prayer and the averments made by the petitioner. In furtherance thereof, written instructions have been provided under the signatures of A.D.M (Finance and Revenue) Lucknow, a copy of which has been provided to the Court for perusal and the same is taken on record. In paragraphs 5 and 6 of the written instructions under the signature of the said officer it has been indicated that as far as the representations moved by the petitioner is concerned, notices have been issued permitting the parties to make their submissions fixing 21.04.2025 and it has further been indicated that no action has been taken which has apprehended by the petitioner as mentioned in the writ petition coupled with the fact that the representation of which the petitioners has sought a direction shall be decided after hearing the parties concerned. In light of the aforesaid and averments made in the written instructions, apparently the relief for which the petitioners has approached this Court already stands readdressed. Hence, no further order or adjudication is required, at this stage, as the matter is under active consideration of the authorities for which the notice has been issued to the petitioner fixing 21.04.2025. With the aforesaid, the petition stands disposed of. Order Date :- 16.4.2025 Harshita Digitally signed by :- HARSHITA High Court of Judicature at Allahabad, Lucknow Bench
