Neutral Citation No. - 2025:AHC-LKO:23009-DB Court No. - 1 Case :- WRIT - A No. - 4290 of 2025 Petitioner :- Dr. Narendra Pratap Singh Respondent :- State Of U.P. Thru. Prin. Secy. Agriculture Education And Research Deptt. Lko. And 4 Others Counsel for Petitioner :- Arun Kumar Pandey,Virendra Patel Counsel for Respondent :- C.S.C.,Prashant Kumar Singh,Prashant Singh Atal Hon'ble Attau Rahman Masoodi,J. Hon'ble Ajai Kumar Srivastava-I,J.
1. Heard learned counsel for the petitioner, learned counsel for the State, Sri Anshuman Singh, Advocate holding brief of Sri Prashant Singh Atal, learned counsel for respondent no.2 and Sri Prashant Kumar Singh,
learned counsel for respondent nos.3 to 5.
2. The benefit of the academic session has been claimed after the expiry of the academic session. At this stage, about five years have already passed when the petitioner attained the age of superannuation. The representation for grant of the benefit of the academic session has been rejected by a reasoned and speaking order.
3. Thus, in our humble opinion, the writ petition is misconceived as the reasons assigned in the impugned
order are far away from being faulty. The petitioner, who has neither worked nor discharged his duties, as such, no claim whatsoever is maintainable for payment of salary for the period which cannot be regained.
4. Accordingly, the writ petition is dismissed. (Ajai Kumar Srivastava-I, J) (Attau Rahman Masoodi, J)
