2. By way of ther writ petition, the petitioner has prayed for following reliefs:
“10.1. That, the Hon'ble Court may kindly be pleased to call the entire records relating to the case of the Petitioner. 10.2 That, the Hon'ble Court may kindly be pleased to issue a suitable Writ and direct the respondents to released the amount of Rs. 2,45,676/- in favour of petitioner and also direct to pay 18% interest per annum on delay payment on said amount, within a period of 30 days. 10.3 Any other relief which Hon'ble Court deems fit and proper in the facts and circumstances of the case and cost of the petition.”

Learned counsel for the petitioner submits that the petitioner pursuant to the notification issued by the office of the Collector- cum-District Magistrate for renovation in the Chamber of Collector, Balrampur-Ramanujganj have participated in the bid proceedings and the work was allotted to the petitioner, to which, he successfully completed the work. The petitioner has also submitted the drawing bills from time to time to the respondents towards the payment of works. However, the respondents have only given assurance and not paid bill amount of Rs.2,45,676/- till date. Learned counsel for the petitioner in support of his contention relied upon Annexure P/1. 4.
On the other hand, learned counsel for the respondents do not dispute the submission of the counsel for the petitioner with respect to the allotment of work to the petitioner which, he has
3 completed and also submitted the bills. He submits that the entire amount towards the bills could not be disbursed for want of funds, as the funds has not been released from the concerned departments and as soon as the fund gets released, the bill amount will also be paid to the petitioner. 5. I have heard learned counsel for the respective parties and also perused the documents on record. 6. Considering the facts and circumstances of the case, nature of grievance raised in the writ petition, submissions of the learned counsel for the respective parties, this writ petition is disposed of with a direction to the Respondents that in view of memo dated 26.08.2020 passed by the Additional Collector, Balrampur- Ramanujganj, the respondent authorities are directed to consider the case of the petitioner and to pass appropriate orders on undisputed amounts of the bills in accordance with law, expeditiously and to make payment of the undisputed dues, preferably within a period of 04 months from the date of receipt of this order. It is made clear that this Court has not expressed any thing on merits and the respondents may consider the case of the petitioner on its own merits. 7.
