PUBLIC PROSECUTOR The court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A1 to A4, seeking regular bail, in Crime No.296 of 2024 of II Town Police Station, Visakhapatnam Commissionerate registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the NDPS Act. 2. Case of the prosecution, in brief, on 01.12.2024, on receipt of credible information, the Sub-Inspector of police along with his staff and mediators rushed to D.No.32-25-26/1, 2nd floor, Kobbarithota, Allipuram, and found the accused in possession of 122.042 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 2 3. Heard. Perused the record. 4. Learned counsel for the petitioners contends that the petitioners have been in judicial custody from 01.12.2024 and prays to grant bail to the petitioners herein. 5. On the other hand, learned Assistant Public Prosecutor opposed to grant bail on the ground that contraband allegedly involved in the present crime is 122.042 Kgs of Ganja, which is a commercial quantity and further submits that the case is still under investigation and some more witnesses are to be examined. 6. In view of the gravity of offence and involvement of commercial quantity of ganja and in view of the bar contained under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioners. 7.
