Neutral Citation No. - 2025:AHC-LKO:21784 Court No. - 18 Case :- WRIT - A No. - 4125 of 2025 Petitioner :- S.I. Mahaveer Singh Pno - 860920092 Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And 3 Others Counsel for Petitioner :- Shikha Srivastava,Shobhit Kumar Rastogi,Suneel Kumar Singh Kalhans,Yogesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioners and Learned Chief Standing counsel for the respondents. The petition has been filed with the following prayer:-
"It is most respectfully prayed that this Hon'ble Court may graciously be pleased to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to consider case of the petitioner for his transfer from District Kanpur Nagar to District Gonda in pursuance of the Government Order dated 07.06.2023. contained in Annexure No. I to the writ petition."
Learned counsel for the petitioner submits that, in accordance with the Government Order dated 07.06.2023, Group C and D employees who are due to retire within two years should, as far as possible, be posted in their home district. It is further submitted that, as per the transfer policy, the petitioner ought to have been considered for a posting in District Gonda. On the other hand, learned Chief Standing Counsel, opposing the submission, submits that the said government policy does not apply to the petitioner, as he is serving as a Sub-Inspector in the U.P. Civil Police. For such personnel, separate guidelines have been laid down under the Government Order dated 24.07.2015, which stipulates that, except for Inspectors and
Sub-Inspectors, non-gazetted police department employees with two years or less of service remaining shall be posted in adjoining districts of their home district. At this stage, learned counsel for the petitioner submits that it would suffice if the petitioner is permitted to submit a representation to respondent no. 3, with a direction for the same to be considered sympathetically. Learned Chief Standing Counsel has no objection to this innocuous prayer. In view of the above, the petitioner is directed to submit a representation before respondent no. 3 within two weeks from today. If such a representation is submitted, respondent no. 3 shall consider and decide it by passing a reasoned and speaking
order within a further period of four weeks. With these observations, the petition stands disposed of.
