The present petition has been filed with the following prayer : "Issue an order or direction in the nature of MANDAMUS commanding opposite parties specially opposite party no. 3 and 4 to ensure the removal of the illegal and unauthorized possession / encroachment over the public pathway plot no. 100 of gata no. 778 recorded in the name of the "Rasta" in the records of the Rural Habitation - Gharaunı (ROH) of Village Nisasin , Gram Panchayat Mohammadpur Kaji, Block and Tehseel Baldirai District Sultanpur as contained in annexure no. 1 of writ petition and restore it in its original form as it was before encroachment taking disciplinary actions against the guilty persons as early as possible within stipulated time framed by this Hon'ble Court." 3. Considering the fact that the petitioner has the efficacious remedy under section 26 of the U.P. Revenue Code, the present petition is disposed off permitting the petitioner to avail such remedy. In case, such remedy is availed, the same shall be decided expeditiously in accordance with law within the time fixed under the statute.
