GP FOR SERVICES II 2 W.P.No.8566 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the representations and appeals made by the petitioner dated 26-10-2024 and 25-03- 2025 requesting the respondents to appoint local married woman to the post of Anganwadi Teacher is available in Pedda Nagulavaram Village, Markapuram Mandal of Prakasam District as illegal, arbitrary, discriminating, extraneous considerations, opposed to the doctrine of legitimate expectation and spirit of public employment besides violative of Arts.14 and16 of the Constitution of India and Consequently direct the respondents to consider the representations and appeals made by the petitioner dated 26-10-2024 and 25-03- 2025 requesting the respondents to appoint local married woman to the post of Anganwadi Teacher is available in Pedda Nagulavaram Village, Markapuram Mandal of Prakasam District Teacher and pass such other order or orders.…” 2. Heard Ms O.Sridevi, learned counsel for the petitioner and P.L.V.S.Prasad, learned Assistant Government Pleader for Women Development and Child Welfare. 3. The petitioner has applied for the post of Anganwadi Teacher in pursuance of the notification dated 03.09.2022. She was issued call letter dated 14.09.2022, for attending the interview scheduled to be held on 15.09.2022. The vacancy relating to the post of Anganwadi Teacher at Pedda Nagulavaram Village, is also claimed by other persons. One Smt T.Bhuvaneswari, filed W.P.No.15902 of 2016, claiming for consideration of her name as Anganwadi Teacher, the writ petition dismissed for non prosecution on 3 W.P.No.8566 of 2025 17.10.2024. However, the respondents have not taken any further steps for filling up the said vacancy. The petitioner herein submitted representations dated 26.10.2024 and 25.03.2025 to consider her name, which is stated to pending. Questioning the aforesaid inaction, the present writ petition is preferred. 4. Learned Assistant Government Pleader for respondents placed on record the instructions vide Rc.No. /A2/2025, dated -04- 2025, stating that with respect to same vacancy yet another writ petition vide W.P.No.22873 of 2024 came to be filed by one Smt T.Lakshmi Chandrakala, who in the interview stated to have secured higher marks, to consider her name for promotion as she was already working as Anganwadi Helper. The same was disposed of by an order dated 23.12.2024, directing the respondents to pass appropriate orders on the representation of the petitioner therein, within a period of four (04) weeks. Though the timeframe fixed in the aforesaid order expired, it is stated that due to administrative exigencies, still the respondents have not passed any orders and they are in the process of disposing the same. 5. Learned counsel for the petitioner, at this stage, submits that it would suffice if the respondents consider and pass appropriate orders on petitioner’s representation. 6. In view of the aforesaid submissions, as the respondents have already seized up and undertaken the exercise of filling up of 4 W.P.No.8566 of 2025 vacancy to the post of Anganwadi Teacher at Pedda Nagulavaram Village, Markapuram Mandal, Prakasam District, in terms of directions issued by this Court in W.P.No.22873 of 2024, they are directed to consider and pass appropriate orders, in pursuance to petitioner’s representations dated 26.10.2024 and 25.03.2025, simultaneously considering merit and eligibility of respective candidates. The said exercise shall be completed by passing speaking orders, strictly in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order. 7. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
