Neutral Citation No. - 2025:AHC-LKO:23590 Court No. - 18 Case :- WRIT - A No. - 4164 of 2025 Petitioner :- Km. Nishu Trivedi Respondent :- State Of U.P. Thru. Addl. Chief Secy. Bal Vikash Sewa Evam Pustahar Lko. And 5 Others Counsel for Petitioner :- Anil Kumar Yadav,Manoj Kumar Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for respondent Nos. 1 to 5. Learned Standing Counsel, on the basis of instructions, submits that the petitioner is living above the poverty line, with a monthly income of Rs. 4,000/- whereas one Deepa Devi, who has been selected, is living below the poverty line, with a monthly income of Rs. 3,500/- as per her income certificate dated 21.10.2024. Perused the record. Considering stipulation mentioned in the Government Order dated 12.03.2023, the selected candidate, being below the poverty line, has rightly been given priority over and above to the petitioner, who is above the poverty line. There appears to be no illegality in the selection of Deepa Devi. The petition lacks merit and is accordingly dismissed. Order Date :- 24.4.2025 R.C.
