This writ petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus declaring the inaction of the respondent No.3 in issuing the conversion proceedings in respect of the petitioner’s land admeasuring to an extent of Ac.2.90 cents situated in Dondapadu Village, Pedavegi Mandal, Eluru District as illegal, arbitrary, contrary to the provisions of the Andhra Pradesh Agricultural Land (conversion for Non-Agriculture) purposes Rules, 2018; consequently direct the respondents to issue the conversion proceedings in favour of petitioner. 2. Heard learned counsel for the petitioner and learned Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that the petitioner herein is the absolute owner and possessor of the agricultural land admeasuring to an extent of Ac.2.98 cents in R.S.Nos.49-1A, 49-2A3C situated in Dondapadu Village, Pedavegi Mandal, Eluru District. While so, the petitioner had submitted an application to the respondents seeking for conversion of the land in an extent of Ac.2.90 cents out of the land in an extent of Ac.2.98 cents from agriculture to non-agriculture land and paid an amount of Rs.1,21,800/- on 30.04.2019 towards conversion tax. For which, the revenue authorities have uploaded the details of the same in ROR. Further, 1B and Katha number in respect to the converted land were also changed from agricultural land to non- agricultural. 4. Learned counsel for the petitioner further submits that the respondent No.1 also issued the Andhra Pradesh Agricultural Land (Conversion for Non- Agricultural Purposes) Rules, 2018 videG.O.Ms.No.98, dated 19.02.2018. He further submits that Rule 4 of the said rules reads as follows: “Conversion: On payment of requisite one time conversion tax the land stands converted and can be used for Non-Agricultural purpose by the declarant.” 5. In view of the said Rule the respondents already converted the subject land from agricultural to non-agricultural land but the conversion proceedings were not issued in favor of the petitioner. Hence, the petitioner herein submitted several representations seeking for issuance of conversion proceedings. But the respondents for the reasons best known to them, neither considered the said representations nor issued any other proceedings. Hence, the writ petition. 6. On the other hand, learned Government Pleader for the respondents expressed that the respondents are ready to consider the request of the petitioner, within a reasonable time. 7. Having regard to the submissions made by the learned counsel for the petitioner and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the respondents to issue land conversion proceedings in favor of the petitioner, pursuant to G.O.Ms.No.98, dated 19.02.2018, within a period of three (03) months from the date of receipt of a copy of this order, in accordance with law. 8. With the above direction, the writ petition is disposed of. No costs.
