Neutral Citation No. - 2025:AHC-LKO:21557-DB Court No. - 2 Case :- WRIT - C No. - 3584 of 2025 Petitioner :- Abida Alias Abida Sugra Respondent :- State Of U.P. Thru. Secy. Energy Deptt. Lko. And Others Counsel for Petitioner :- Ana Fatma,Arshad Jameel,Mohd. Salman Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioner is aggrieved by repeated electricity bills of different amounts, however, learned Standing Counsel for the Electricity Corporation says that the last bill paid for consumption of electricity at the premises in question was in 2019, that too only of Rs.282/- and on 24.07.2024, an inspection was conducted, wherein it was found that the electricity meter had been thrown away and electricity was being used, therefore, being a case of theft, provisional assessment was made and served upon the petitioner, copy of which is annexed as Annexure No.4 to the Writ Petition, which is the amount payable consequent to the aforesaid inspection. However, learned counsel for the petitioner says that objections were filed on 27.08.2024, copy of which is annexed at Page 25 to the Writ Petition. We fail to understand as to how without a final assessment, a demand notice has been raised, contained as Annexure No.1 to the Writ Petition, that too in the name of different person, though the same premises, and the amount mentioned therein is Rs.1,30,102/-, how this amount increased from Rupees Eighty Six Thousand and Odd on 07.08.2024 to Rupees One Lakh Thirty Thousand and Odd on 20.03.2025 and in addition to it, a disconnection notice has been given mentioning dues of Rupees Twenty Eight Thousand and Odd, which is dated 27.08.2024, however, this may be the dues pertaining to the period prior to
27.08.2024. Let the petitioner's objection to the provisional assessment, as annexed at Page 25 to the Writ Petition dated 27.08.2024, be considered and a final assessment be made in the matter and the same be served upon the petitioner. If aggrieved, the petitioner
may avail the remedy under Section 127 of the Electricity Act,
2003. If there is any other grievance, the petitioner may avail any other remedy, as may be prescribed in law. Let the assessment be made as aforesaid within one month, unless there is any legal impediment.
Needless to say that till such final assessment is made, the demand notice, annexed as Annexure No.1 to the Writ Petition, shall not be acted and it shall abide by the final assessment
order. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
