The learned counsel for the petitioner would submit that the petitioner is one of the villagers in the village and they decided to conduct festival for the Shri Elaikaatha Amman temple on 28.04.2025 and also they decided to conduct adal padal program on that date. For that, they approached the first respondent for granting permission and the same was rejected through order, dated 01.04.2025. The reason stated by the first respondent is that the neighbouring villagers also would take part in the adal padal program. Therefore, it will create law and order 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.10703 of 2025 issue. The above said reason is not a ground to reject the conduct of cultural program. Therefore, the order passed by the first respondent is liable to be quashed. The learned counsel for the petitioner undertakes to conduct adal padal program without any law and order issue. 3. The learned Additional Public Prosecutor (Crl.Side) for the respondents would submit that they received the representation of the petitioner, dated 01.04.2025 and the same was rejected on the same day by citing the law and order issue. Therefore, the order passed by the first respondent is in order and the petition is liable to be dismissed. 4. This Court heard both sides and perused the records. 5. The villagers have decided to conduct cultural program for the temple festival on 28.04.2025 and thereby they sought permission from the Police, the same was rejected by the first respondent by citing the law and order issue. The first respondent merely on the ground of law and order issue cannot decline to grant permission and the first respondent ought to have permitted the petitioner by imposing some conditions. Since the adal padal program is one of the cultural program and the petitioner also undertakes to conduct the program without any law and order issue, it is appropriate to allow this petition. 7. Accordingly, this petition is allowed and the impugned order passed by the first respondent, dated 01.04.2025 in Na.Ka.No.24/CO/SVG/2025, is quashed. The first respondent is directed to grant permission by imposing appropriate conditions for conducting adal padal program on 28.04.2025 from 06.00pm to 10.00 pm. The respondents also directed to provide adequate police protection and monitor the events and the petitioner also directed not to praise any community people. 8. With the above said observations and directions, this writ petition is disposed of.
