Neutral Citation No. - 2025:AHC-LKO:26595-DB Court No. - 2 Case :- WRIT - C No. - 4252 of 2025 Petitioner :- Ketati Devi And Another Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko And 6 Others Counsel for Petitioner :- Ram Prasad Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard Sri Ram Prasad Dwivedi, learned counsel for the petitioner as also the learned Addl. C.S.C. and perused the record. The only ground pressed by the petitioners' counsel for challenging the acquisition-notification issued under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, dated 27.02.2025, is that though the petitioners had purchased the land, which has been acquired by paying sale-consideration on per square feet/per square meter basis, but now the compensation has been calculated treating it to be an Agricultural Land, which it is not. We are of the opinion that this cannot be a ground for challenging the acquisition. This can be a ground for challenging the amount determined by the opp. parties as compensation before the appropriate Forum, therefore, we dispose of this petition with these observations and with liberty to the petitioners to raise this claim at the appropriate stage before the appropriate Forum or Authority, as the case may be.
