1. This court is not convinced that the petitioners are coming up with fullness of facts to maintain the present writ petition that too in a representative capacity the end objective of which is actually aimed and addressed against the private respondent No.7-Javid Ahmad Shah so as to cease his functioning as Lambardar of village Sedow, Tehsil and District Shopian.
2. The complaint against said the respondent No.7-Javid Ahmad Shah is said to be already pending
consideration before the Authorities concerned but without any end result and that is how the present writ petition in a representative capacity is sought to be maintained by eight Inhabitants of village Sedow, tehsil and district Shopian.
3. The petitioners have not placed on record for the perusal of this Court as to vide which order the respondent No. 7-Javid Ahmad Shah came to be nominated/appointed/elected as Lambardar of village Sedow, tehsil and district Shopian and on what terms and conditions and for how much duration.
4. In absence of this elementary order being on record the persons intending to maintain the writ petition cannot be said to be acting with due diligence at their respective end in seeking leave to maintain the writ petition in a representative capacity, as such, application CM No. 2061/2025 is, therefore, not entertained and hence dismissed without prejudice to the right of the Inhabitants to come up with a writ petition bearing essential facts and documents relatable to the respondent No. 7’s appointment in particular as a Lambardar.
5. Consequently, writ petition WP (C) No. 805/2025 shall also stand dismissed.
