Mr. Devesh Ghildiyal, Brief Holder for the State of Uttarakhand. 3. Ms. Anjali Bhargava, Advocate for the Gram Sabha/respondent no. 24. 4. Petitioner moved an application for demarcation under Section 41 of Land Revenue Act, which is pending before the Assistant Collector, First Class, Dehradun. 5. By means of this writ petition, petitioner has sought a direction to the Assistant Collector to expedite the hearing of the said application. 6. Learned State Counsel, on instructions, submits that there is discrepancy in the revenue map with regard to Khasra No. 1447, which was noticed during the filed visit made by revenue authorities, on 23.01.2023. Thus, he submits that the appropriate remedy for the petitioner would be to move an application under Section 28 of the Land 2025:UHC:1974 Revenue Act. 7. Ms. Anjali Bhargava, learned counsel appearing for the Gram Sabha points out that one Smt. Sunita Kumar has filed objection contending that she is the owner of Khasra No. 1447; and therefore, there is title dispute also regarding the said khasra number. 8. It is further contended by learned counsel for the respondent that the other parties with whom petitioner has a dispute regarding land in question, are not party to the writ petition. 9. Be that as it may, since petitioner’s application for demarcation is pending consideration since 2021, therefore, the writ petition is disposed of with a request to Assistant Collector concerned to make endeavour to decide the application, one way or the other, within four months from the date of production of certified copy of this order.
