Neutral Citation No. - 2025:AHC-LKO:23817-DB Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 3162 of 2025 Petitioner :- Ishan Saluja Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko And 4 Others Counsel for Petitioner :- Anurag Arora Counsel for Respondent :- G.A. Hon'ble Vivek Chaudhary,J. Hon'ble Ram Manohar Narayan Mishra,J.
1. Heard Shri Anurag Arora, learned counsel for the petitioner at length and learned A.G.A. for the State and perused the material available on record.
2. The petition seeks issuance of a writ, order or direction in the nature of certiorari for quashing the First Information Report dated 29.03.2025 registered as Case Crime No. 0048 of 2025, under Section 85, 115(2), 352, 351(3) B.N.S., 2023 and under Section 3/4 Dowry Prohibition Act, 1961 lodged against the petitioner.
3. From a perusal of the impugned F.I.R., it appears that on the basis of the allegations made therein a, prima facie, cognizable offence is made out against the petitioner, so the relief as claimed by the petitioner in the present petition cannot be granted under Article 226 of the Constitution of India. Specific allegations are made against the petitioner in the F.I.R., hence, no case for interference is made out.
4. Accordingly, the writ petition is dismissed being misconceived. . (Ram Manohar Narayan Mishra, J.) (Vivek Chaudhary, J.) Order Date :- 25.4.2025 Arvind Digitally signed by :- ARVIND KUMAR SRIVASTAVA High Court of Judicature at Allahabad, Lucknow Bench
