Applicant Bunty is seeking anticipatory bail in F.I.R. No.597 of 2024, under Sections 109, 115(2), 190, 191(2), 191(3) of B.N.S.S. registered at Police Station Bhagwanpur, District Haridwar. 4. Learned State counsel vehemently opposed the anticipatory bail application on the ground that serious allegations have been levelled by the complainant in the F.I.R., therefore, the applicant is not entitled to get this relief at this stage. 5. Learned State counsel would further submit that an equally efficacious remedy is available to the applicant/ accused to file the anticipatory bail application before the Sessions Court but without exhausting the same, the applicant has straightaway approached this Court for getting the anticipatory bail. 6. To this, counsel for the applicant/accused seeks permission to withdraw the present application with liberty to approach the Sessions Court for seeking anticipatory bail. 7. In view of the above, the anticipatory bail application is hereby dismissed. However, applicant is at liberty to approach the Sessions Court for seeking anticipatory bail. (Vivek Bharti Sharma, J.)
