Present applicant–Nikhil Kumar is in judicial custody since 18.09.2024 and seeking bail in relation to FIR/Case Crime No.0383 of 2024, registered on the basis of FIR dated 18.09.2024 at Police Station Ranipur, District Haridwar, wherein the present applicant along with three persons have been implicated for the offences punishable under Section 178, 179, 180, 182, 61(2) of the B.N.S. Act,
2023.

Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated merely on the ground of recovery of some counterfeit currency though as per the prosecution, the main accused is Mohit, from whose room the printer, scissors and the fake currency as well some papers were recovered.

Learned counsel for the applicant also submits that the bail application of other co-accused Neeraj was also rejected by this Court on the ground of having criminal history. Apart from this, learned counsel for the applicant submits that the applicant has no previous criminal history; the charge-sheet has already been filed and he is languishing in jail since 18.09.2024, therefore, there is no need of custodial interrogation.

6. On the other side, the State counsel have not disputed this fact that the charge-sheet has already been filed and therefore is no need of custodial interrogation.
7. After hearing the arguments, as advanced by learned counsel for the parties and further taking into
consideration that the charge-sheet has already been filed and as such, there is no need of custodial interrogation of the present applicant and the applicant is languishing in jail since 18.09.2024, this Court is of the view that the applicant deserves to be enlarged on bail.
8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed.
9. Let the applicant, namely, Nikhil Kumar, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
