Neutral Citation No. - 2025:AHC-LKO:22059-DB Court No. - 2 Case :- WRIT - C No. - 3669 of 2025 Petitioner :- Zafar Ahmad Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Others Counsel for Petitioner :- Indu Prakash Singh,Aradhana Singh Counsel for Respondent :- C.S.C.,Amit Jaiswal Ojus Law Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. After arguing at some length, learned counsel for the petitioner submits that there is an alternative remedy before the Debts Recovery Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, which has already been availed, however, he says that the interim relief application has been fixed for 02.06.2025, whereas the District Magistrate is proceeding to dispossess the petitioner, therefore, he confined his relief to the extent of expeditious disposal for interim relief application, to which, learned counsel for the opposite parties have no objection. Learned counsel for the petitioner also undertakes to move an application for amendment of the application so as to incorporate a challenge under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The Debts Recovery Tribunal, Lucknow is directed to consider the application for interim relief, filed by the petitioner in S.A. No.388/2021, at the earliest and pass appropriate orders thereon within ten days of certified copy of this order being placed before it. The Writ Petition stands disposed of. (Om Prakash Shukla,J.)
