Heard learned counsel for the petitioner, Shri Hemant Kumar Pandey, learned Standing Counsel for the State/opposite party Nos. 1 to 4 and perused the record. In view of order proposed to be passed, issuance of notice to the private- opposite party is hereby dispensed with. The instant petition has been preferred seeking following main relief:-
"(i) Issue a writ, order or direction in the nature of Mandamus commanding thereby commanding and directing the opposite party no.2 to 4 to stop the unauthorized construction work made by opp. party no.5 during consolidation proceeding without granting permission under section 5 of U.P.C.H. At the very outset learned counsel for the petitioner says that justice would suffice if a direction is issued to the opposite party No.2/Settlement Officer of Consolidation, District Ambedkar Nagar to consider and decide the application dated 07.04.2025 moved by the petitioner, at the earliest. To the aforesaid, there is no objection from the other side. In view of above, the present petition is disposed of with a direction to the opposite party No.2/Settlement Officer of Consolidation, Ambedkar Nagar to consider and decide the application dated 07.04.2025 moved by the petitioner, after taking note of the entire issue and the law on the issue, within a maximum period of three months from the date a certified copy of this order is produced before him, after affording full opportunity of hearing to the party to the litigation and without granting unnecessary adjournment to either party, if there is no other legal impediment in this regard.
It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 17.4.2025 ML/- Digitally signed by :- MUNNA LAL High Court of Judicature at Allahabad, Lucknow Bench
